The GAO exists to read other people's paperwork and report that nobody read the paperwork; it is the institutional conscience of a government that does not have one, and it produced this year several hundred pages on federal bodies paying invoices they had not examined. It did not examine its own. The lesson is not that ninety-four thousand dollars is a great sum — it is trivial, which is precisely the point. The standard an institution enforces on others is a standard it believes it embodies rather than one it believes applies to it, and the belief is always sincere. Every watchman has to be watched, which raises the question that has never once been answered in the history of administration: by whom, and who is auditing him?

This is the characteristic modern failure and it is not ignorance: it is an institution that has confused recording a hazard with addressing one, and that experiences the making of a record as the discharge of a duty. A firm of this kind sells one thing, and it is not legal knowledge — it is the proposition that somebody powerful has behaved badly and that these particular people can be trusted to say so. Which makes the letterhead the entire product. Two men built a global practice on having their names believed, and have now both instructed it, in writing, to stop saying them: the asset and the liability turned out to be the same eleven letters. Vanity put the names up there. Vanity is taking them down.

A complaint was received, a review was conducted, data was considered, and a change was announced — the full liturgy of responsiveness, performed in every particular, to deliver six seconds. What is remarkable is not the meagreness of the remedy but that the meagreness is invisible from inside the process, because the process measures itself by whether a change was made and not by whether the change was worth making. This is how an institution can be scrupulously attentive and completely useless at the same time, and it is the ordinary condition of regulated life.

An estimate is a claim to knowledge, and this one brackets a quantity of money greater than the national output of Hungary. Nobody involved is embarrassed, because the range is reported as a finding rather than as an admission, and the difference between those two things is the difference between a state that governs its revenue and one that observes it from a distance, taking notes. The confident part is not the number. It is the decision to publish it as though it were one.

Consider the arithmetic of the confident. The estimated annual haul is $360 million; the regime's complete enforcement record to date is one company, one fine of half a million, and one man detained at home for six months. A leniency programme works by making each conspirator fear the others, which means bid-rigging survives only where every participant believes his co-conspirators are more loyal to him than to their own interests — a belief no one holds about himself. They are not being warned. They are being invited to reconsider their friends.
The Professional Body Has Replaced Its Own Recommended Trainee Salary With a Suggestion That Firms Consider Somebody Else's Number
Begin with a statutory minimum. Replace it with a recommended minimum. Replace the recommended minimum with a recommendation to consider a figure calculated by an unrelated charity. At each stage the body retains its full authority to have an opinion and divests itself of the opinion, so that what remains is an institution occupying the moral position of caring about trainee pay while holding no view whatever about what trainee pay should be. A number can be argued with. This cannot, which is the entire attraction.

The entire apparatus of permits and waste transfer notes exists for one reason, which is that we are reliably a species that will put its rubbish on another man's grass the moment the gate is left open — and the field was cleared at public expense, so the public has now paid twice, once for the regulator and once for the ground.

Recusal is the one act of judicial humility the robe permits: a declaration that this particular judge's impartiality could reasonably be doubted, and that the file must go to cleaner hands. Performed once, it is integrity. Performed seventeen times on the same litigant, by benches from a district court to the Supreme Court, it stops describing the judges and starts describing the case — and the doctrine of scrupulous withdrawal has quietly inverted into a mechanism for never deciding anything at all. Thirteen years of the most fastidious conscience in the world, and the man still does not have a ruling.
